Niagara man injured in fall wins nearly $40 Million

AWARD: The 1997 accident left the Town of Niagara man permanently disabled.

A Town of Niagara man permanently injured from a fall at a Lockport chemical company in Lockport was awarded the largest personal injury settlement ever received by a Niagara County resident, his attorneys said.

_____was awarded $39.6 million in damages in late March by Supreme Court Justice Christopher J. Burns after a marathon 11-hour pre-trial conference. The matter was scheduled for a May 6 trial. According to previously published Greater Niagara Newspaper reports, _____was an employee of the Blue Ox Roofing Co. in Lockport at the time of his fall.

On December 17, 1997, _____then 23, fell through a rotted part of a wooden roof he was replacing at Twin Lake Chemical Co. and onto a concrete floor, suffering a serious head injury, newspaper reports said.

_____Attorneys - Robert T. Koryl of Niagara Falls _____ - said both the chemical and roofing companies were found liable in earlier court proceedings in October 1998 and January of this year. As part of the settlement, the company names were not disclosed.

The terms of the settlement call for an initial cash payment of $5 million.

He will receive cost of living adjusted payments during his lifetime projected at not less than $33,799,924 with a minimum guaranteed future payment of not less than $13,213,603 payable to his family if he dies prematurely.

Koryl said the first payment already has been received.

Also, the Worker's Compensation insurance carrier waived any lien or claim for nearly $800,000 in benefits already paid.
